‘Del Boy Pedro’ ordered to pay back more than £20,000 from the sale of counterfeit goods

On Friday 29th May at Merthyr Tydfil Crown Court, Jonathon Nicholls of Poplar Place, Trefechan, Merthyr Tydfil was ordered to pay back over £20,000 as a result of Proceeds of Crime action taken by the Trading Standards Service at Merthyr Tydfil County Borough Council.
Nicholls was sentenced to a suspended prison sentence in September 2014 after pleading guilty to 13 offences under the Trade Marks Act relating to the possession and supply of counterfeit goods, including brands such as Dre Beats headphones, clothing bearing the registered trademarks of Superdry, Nike, North Face, Ugg and Adidas, together with MAC make up, Converse trainers, GHD straighteners and watches bearing ICE and Michael Kors trademarks.
Following conviction, a Financial Investigation under the Proceeds of Crime Act was undertaken by the Trading Standards Service to establish what benefit Nicholls had made from his criminal activity.  The Court determined £13,791, was made from crime, along with £6,774 in costs as a result of convictions relating to the sale of counterfeit goods sold from a Facebook account in the name of ‘Del Boy Pedro’. 
Nicholls was told the money must be repaid within two months or face a custodial sentence of 8 months in default of payment.
Paul Lewis, Trading Standards and Licensing Manager states “Trading Standards actively utilise the powers under the Proceeds of Crime Act to recover the benefit made by criminals from their illegal activities.”
Councillor David Jones, Cabinet member for Trading Standards states “This is a clear message that crime does not pay and highlights the Authorities determination to stamp out unfair competition to legitimate businesses in Merthyr Tydfil.”
